1. Who we are
This Privacy Policy explains how Alan King Group (“AKG”, “we”, “us”) collects, uses, shares, and protects personal information. Alan King Group is a trade name of Happy Trading LLC, a Wyoming limited liability company, located at 30 N Gould St., Suite R, Sheridan, WY 82801.
This policy covers our websites (including alankinggroup.com), our manufacturing and brand-operations services, and the AKG Operator platform (the “Services”). Where we operate a consumer brand store, that store may have its own additional privacy notice.
2. The information we collect
We collect information you give us, information collected automatically, and information from third parties.
Information you give us:
- · Waitlist & contact: your name, email address, phone number, brand name, store URL, platform, revenue range, SKU count, social handle, the programs you're interested in, and anything you tell us about your operations.
- · Account & client information: contact and billing details, the brand and product information you provide, and communications with us.
- · Marketing preferences: your email and SMS opt-in choices and consent records.
Information collected automatically:
- · Usage and device data: IP address, browser type, pages viewed, and similar analytics; cookies and similar technologies (see “Cookies”).
Customer data processed on behalf of our customers:
- · When you use AKG Operator, we connect to your store and tools (e.g., Shopify, email/SMS platforms, ad accounts) and process data on your behalf — including your customers' order and contact information. For this data, you are the controller and we are the processor (see “AKG Operator and your data”).
3. How and why we use information
We use personal information to:
- · Provide, operate, and improve the Services and respond to your requests;
- · Evaluate and onboard brands that join our waitlist or become customers;
- · Send transactional messages (e.g., confirmations and service notices);
- · Send marketing communications where you have opted in, and let you opt out at any time;
- · Maintain security, prevent fraud and abuse, and comply with legal obligations.
Where the GDPR or similar laws apply, we rely on these legal bases: performance of a contract, your consent (e.g., marketing), our legitimate interests (e.g., operating and securing the Services), and compliance with legal obligations.
4. AKG Operator and your data (we are a processor)
When you use AKG Operator, you remain the controller of your business and customer data, and we act as your processor / service provider. We process that data to provide the Services and, as you authorize, to secure and improve our Services. We treat it as confidential and do not sell it. How we use data to develop our AI models — using de-identified data, with an opt-out — is described under “AI, third-party AI providers, and your data.”
- · We do not sell your data or your customers' data.
- · We engage sub-processors (e.g., infrastructure and third-party APIs) to provide the Services; we maintain a current list at alankinggroup.com/subprocessors and provide advance notice of material changes, and we remain responsible for their compliance.
- · On termination, we will return or delete customer personal data within 90 days, except where retention is required by law.
- · We will assist you in responding to data-subject requests and will notify you without undue delay of any confirmed personal-data breach affecting your data.
- · For business customers subject to the GDPR or similar laws, a separate Data Processing Agreement (DPA) is available at alankinggroup.com/dpa and governs this processing.
5. AI, third-party AI providers, and your data
Some features use artificial intelligence to draft content, summarize, and assist your operations, powered by third-party AI providers.
- · We treat your data as confidential and do not sell it.
- · We use your data to operate, secure, and improve our Services.
- · Where we develop or train our own AI models, we use de-identified or aggregated data only (data that does not identify you or your customers). You can opt out of having your data used to improve or train our models by emailing alan@akings.com.
- · Our Services use multiple third-party AI providers, currently including Anthropic, OpenAI, Google (Gemini), Kling, and Higgsfield. When you use AI features, relevant data may be processed by these providers under their own terms and privacy policies, which you should review and to which your use may be subject.
- · You can choose which of these AI providers we use on your data, or disable specific ones (for example, to exclude a provider or region you'd prefer not to use), by emailing alan@akings.com.
- · AI outputs can contain errors. They are provided to assist you, and you are responsible for reviewing them before they are sent or published. Final decisions remain yours.
6. Email and SMS communications
Email: with your consent we send updates and marketing. You can unsubscribe anytime via the link in any email or by contacting us; you will still receive transactional messages.
SMS/Text: if you separately opt in and provide a phone number, we may send recurring automated messages. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. We keep records of your consent and honor opt-outs promptly.
7. Cookies and analytics
We use cookies and similar technologies for essential functionality, to remember preferences, and to understand usage. You can control cookies through your browser settings; disabling some may affect functionality. Where required, we obtain consent for non-essential cookies.
8. How we share information
We share personal information with:
- · Service providers and sub-processors who help us run the Services (e.g., hosting, payments, email/SMS, analytics), under contract and only as needed;
- · Professional advisors, and authorities where required by law or to protect rights and safety;
- · A successor entity in connection with a merger, acquisition, or asset sale.
We do not sell personal information.
9. International data transfers
We are based in the United States and may process data in the U.S. and other countries. Where we transfer personal data from the EEA, UK, or Switzerland, we use appropriate safeguards such as the European Commission's Standard Contractual Clauses and/or applicable data-transfer frameworks.
10. Data retention
We keep personal information only as long as needed for the purposes described here, to comply with legal obligations, resolve disputes, and enforce agreements. Waitlist data is retained for the duration of the early-access program. Customer data is handled per our agreement and the DPA, including the 90-day return/deletion commitment on termination.
11. Security
We use reasonable technical and organizational measures to protect personal information, including encryption in transit and at rest, access controls, and a documented incident-response process. No method of transmission or storage is completely secure.
12. Your rights
Depending on where you live, you may have rights to access, correct, delete, port, or restrict use of your personal information, to object to certain processing, and to withdraw consent. To exercise these rights, email alan@akings.com.
California (CCPA/CPRA): you have rights to know, delete, correct, and to opt out of “sale” or “sharing” of personal information — we do not sell or share your personal information as those terms are defined. When we process data on behalf of a merchant, we act as a “service provider,” and consumers should direct requests to that merchant. We will not discriminate against you for exercising your rights.
EEA/UK: you may also lodge a complaint with your local data-protection authority.
13. Children
Our Services are for businesses and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, contact us and we will delete it.
14. Third-party links
Our Services may link to third-party websites and tools we don't control. Their privacy practices are governed by their own policies.
15. Changes to this policy
We may update this policy from time to time. We will post the updated version with a new “last updated” date and, where appropriate, provide additional notice.
